Cook Agreement

Version 2026-10-v1

About this agreement

Draft — pending owner approval. This Cook Agreement is not final and is not ready for production use. Proposed effective date: [EFFECTIVE DATE].

This agreement describes participation in CookThisApp, operated by [COMPANY LEGAL NAME], [REGISTERED ADDRESS], KVK [KVK NUMBER], VAT [VAT NUMBER]. Contact: [CONTACT EMAIL]. Bracketed details, including [KVK NUMBER], are placeholders awaiting owner confirmation. It supplements the Terms.

A Cook offers a Dish, an app source-code listing with versions and related materials. A Buyer obtains permission under a License. A Kitchen Report is the automated assessment of a particular version. You keep copyright in your own work; a sale grants the selected License rather than assigning ownership.

Eligibility and onboarding

You may sell as a private person; forming a company is not a platform requirement. Give accurate account, country and payout information and comply with obligations applicable to your activity. A studio is a public brand associated with your account.

Paid selling requires eligible Stripe Connect Express onboarding, enabled payment and payout capabilities and acceptance of the versioned Cook Agreement. Stripe collects identity, bank and tax onboarding information. Restrictions on your Stripe account may hide paid offers. Free publication follows the platform's publication checks.

Optional first and last names in profile settings remain private and are never shown to other users. Your username and studio information are public. This does not remove any separate legal requirement to identify a seller; the applicable disclosure model requires owner approval.

Your rights and listing duties

You confirm that you own or have sufficient rights to submit, analyze, distribute and license the Dish and its associated materials. Disclose upstream code, licenses and lineage, preserve required notices, and do not submit stolen code, secrets or personal information without permission.

Listings must accurately describe implemented features, requirements, dependencies, external costs, limitations, selected License tiers, updates and support. Current publishing rules block a Dish's own GPL/AGPL code and warn about GPL/AGPL dependencies. A successful scan is not legal clearance.

Permission to operate the service

You permit CookThisApp and its service providers to store, copy, normalize, scan and analyze submitted materials, display listing and report information, and prepare and deliver licensed archives to entitled Buyers. This includes isolated build environments, per-License watermarking, LICENSE files and retained purchase evidence.

Kitchen Reports use automated scans and AI analysis through OpenRouter and a third-party AI provider. Relevant source excerpts and related materials may be sent for that analysis. Reports can contain errors and are not guarantees of security, quality or ownership. No promise of provider zero retention or exclusion from training is made without verified provider terms. See the Privacy Policy.

Fees, payment status and payouts

Stripe payments currently operate in test mode; test balances and payouts are not real money. The current test checkout uses a 12% platform fee and a provisional processing-fee estimate of 2.9% plus USD 0.30, deducted from the sale subtotal. That estimate is not a statement of Stripe's actual fee. Live fee treatment and any waivers must be confirmed before live sales.

New and existing test Express accounts use a daily automatic payout schedule with a 14-day delay, or Stripe's maximum permitted delay in countries with a lower cap. The applied delay and any country cap are shown on /admin/payments. Stripe counts business or calendar days according to country. Payouts remain subject to refunds, chargebacks, verification, holds and Stripe or bank processing. A payout is not a guarantee of receipt in a bank account on a particular day.

Refunds and chargebacks may reverse proceeds and applicable fees. Already paid amounts may create a negative balance recovered from future sales. Investigations or provider restrictions may delay availability. App and source-code sales must stay on CookThisApp; do not solicit off-platform payment for those sales to avoid marketplace fees or safeguards. Support may be arranged and paid for directly between Buyer and Cook. CookThisApp does not take payment for support and is not a party to any support agreement.

Taxes and reporting

You are responsible for taxes applicable to your income and activity, required registrations and accurate tax information. Any tax calculated at checkout does not settle all of your tax obligations or establish which party legally collects and remits it. The platform's own tax duties remain its responsibility.

DAC7 reporting may apply. If applicable, the platform may need to collect, verify, retain and report seller and transaction information. Applicability depends on the relevant activity and law; selling as a private person does not by itself determine the result. This draft does not declare every Dish sale reportable.

Delivery, updates and support

Buyers receive per-License watermarked archives with LICENSE-COOKTHISAPP.txt. Links expire after 15 minutes, with 20 downloads per License, per version, per day. Download evidence includes time, hashed IP, user agent and archive hash.

Existing Buyers retain access to purchased versions when you unpublish or delete your Cook account, subject to valid License restrictions. New versions are included only as recorded in the purchased entitlement. Do not promise updates or support you cannot provide.

Any support scope, replies, fixes, hours and payment are agreed directly between you and the Buyer. CookThisApp does not refund direct support payments or handle support disputes; the source-code refund and dispute processes below do not apply to support.

Refunds, disputes and moderation

A Buyer can obtain a full self-service refund within 14 days of payment if nothing was downloaded. Source-code disputes for material differences from the listing must be opened within 14 days of payment. You may respond with evidence; an admin need not wait for your reply. AI may recommend an outcome, but a human decides. Follow the Refund Policy.

Chargebacks freeze the License. A chargeback won by the platform restores it unless independently restricted; a full refund revokes it. Reported rights violations or malware may lead to suspension, removal or account restrictions under the Content Policy. Provide evidence of your rights when challenged. Copyright cases follow the DMCA / Copyright Policy.

Ending participation and appeals

You may stop new sales by unpublishing. Withdrawal does not retract already granted Licenses or eliminate records needed for delivery, disputes and legal duties. Raw uploads are deleted 7 days after successful processing; normalized purchased source and reports have separate retention.

Send questions and appeals with the item and decision details to the admin at [CONTACT EMAIL]. Nothing here excludes mandatory rights or liability that cannot lawfully be excluded. Proposed governing law and court: [GOVERNING LAW / COURT]. Versioned re-acceptance is required when the Cook Agreement changes; this draft is not owner-approved final text.
